Case dismissed against police-reform advocate
An outspoken advocate of police reform in NSW, Dirk Nierop, won a court battle against the NSW Police in Sydney today, 2 October, 2009.
After a hearing which lasted six hours at Waverley Local Court, the magistrate dismissed the case.
Nierop, 48, of Allambie in Sydney, was charged with working as a security guard without a relevant licence.
He had been charged by NSW Police under the Security Industry Act with carrying on a security activity without the security licence at Doncaster Hotel in Kensington on October 21, 2007.
Nierop, a government-employed security guard and former hotel bouncer, is the author of an outspoken internet site called "NSW Police State" at www.nswpolicestate.com .
On this web site he claims he has been the victim of corruption within the police force.
After the court hearing today, he said, "I believe the police trumped up this charge against me to try to keep me quiet."
His plea of not guilty to the charge was entered at the court on May 19, 2009.
He allegedly was acting as a crowd controller at the time of the alleged offence.
Police charged him and fined him $5,500 but he did not pay.
Nierop was convicted in the District Court Sydney in 2007 of assaulting Shane Bullock at Collaroy on April 9, 2006.
Then he was acting as a security supervisor at the Surf Rock Hotel in Collaroy when Bullock was a patron of the hotel.
The court found Nierop guilty of occasioning actual bodily harm but not guilty of maliciously inflicting grievous bodily harm with intent.
Nierop was convicted of the assault on February 23, 2007, but this offence was dismissed by the court on May 8, 2007, and no conviction was recorded.
He is employed as a security officer by the NSW Government.
